CUSTOMER SERVICE AGREEMENT & LIABILITY WAIVER

AUTHORIZATION & OWNERSHIP
Customer authorizes Expert Disposal & Recycling Services, LLC (“Expert Disposal”) to remove, transport, recycle, donate, sell, or dispose of materials from the property.
Customer certifies they are the lawful owner of the materials being removed or have authority to authorize their removal. Upon removal, all items become the sole property of Expert Disposal, and Customer waives all ownership rights and claims to such items.
DUMPSTER RENTAL TERMS
Included Weight Allowances
· 10-Yard Dumpster: Up to 2 tons
· 20-Yard Dumpster: Up to 3 tons
· 30-Yard Dumpster: Up to 5 tons
Additional Charges
· Rental extensions: $20 per day
· Overweight loads: $75 per ton over included weight (up to 10 tons)
· Loads over 10 tons: $100 per ton
· Mattresses: $50 each
· Additional trip charges may apply if access is unavailable for delivery or pickup
Customer shall not move or relocate the dumpster after delivery and agrees not to fill the dumpster above the designated fill line. Expert Disposal reserves the right to refuse pickup of overloaded containers until excess material is removed.
PROHIBITED MATERIALS
The following materials are not permitted in dumpsters or junk removal loads:
Hazardous waste, chemicals, fuels, oils, antifreeze, explosives, asbestos, medical waste, paint, batteries, tires, electronics, refrigerators, air conditioners, Freon-containing items, food waste, grass clippings, manure, dead animals, wet concrete, or any illegal materials.
Customer assumes full responsibility for prohibited materials and agrees to pay any resulting disposal fees, fines, cleanup costs, transportation costs, or legal expenses.
CUSTOMER RESPONSIBILITIES
For dumpster rentals, Customer assumes care, custody, and control of the container while it remains on the property and is responsible for its contents, safe use, and compliance with all applicable regulations, permits, and HOA requirements.
Customer is responsible for providing safe and unobstructed access for service and for identifying and protecting underground utilities, irrigation systems, septic systems, and other concealed property improvements.
LIABILITY WAIVER & INDEMNIFICATION
Customer understands that junk removal operations, dumpster delivery, pickup, and vehicle access may result in incidental damage to driveways, roads, sidewalks, culverts, landscaping, lawns, fences, flooring, walls, structures, and other property improvements.
Customer releases, waives, and agrees to hold harmless Expert Disposal, its owners, employees, contractors, and agents from any claims, damages, losses, injuries, delays, or expenses arising from:
· Junk removal services
· Dumpster rental services
· Delivery or pickup activities
· Vehicle access on Customer property
· Property damage
· Personal injury or death
· Pre-existing property conditions
· Acts of third parties
· Weather delays or circumstances beyond Expert Disposal’s control
Customer further agrees to defend, indemnify, and hold harmless Expert Disposal from any claims, damages, fines, liabilities, costs, or attorney fees resulting from Customer’s breach of this Agreement, improper use of a dumpster, prohibited materials, or claims arising from Customer’s use of Expert Disposal services.
PAYMENT TERMS
Payment is due upon completion of service unless otherwise agreed in writing. Customer agrees to pay all service charges, rental fees, overweight fees, extension fees, disposal fees, taxes, and other applicable charges. Past-due balances may be subject to collection costs and attorney fees.
CUSTOMER ACKNOWLEDGMENT
By signing electronically, Customer acknowledges that they have read, understood, and voluntarily agree to all terms contained in this Customer Service Agreement & Liability Waiver.
